Mock Trial: Machiesmo v. Rowdy Grill: A Professional Negligence Trial

This three-hour seminar is designed to teach agents and brokers the impact of early risk assessment for a policyholder, appropriate documentation in the submission and placement of an general liability insurance policy, underwriting of an insurance risk, the unfortunate result of a coverage disclaimer, and the way the insurance broker becomes a “stop gap” for a policyholder in the event there is no coverage. It shows the situation from a multitude of perspectives—from the policyholder’s vantage, the retail insurance broker, a wholesale intermediary and an insurance company placing the risk. It gives insurance licensees the legal concepts and remedies that are related to analysis of risk and appropriate insurance for a policyholder, identifying and explaining the sources of liability to the insurance broker in the placement of coverage, and the type of missing documentation that can be problematic for the broker.
