Mock Trial: Machiesmo v. Rowdy Grill: A Professional Negligence Trial
This three-hour seminar is designed to teach agents and brokers the impact of early risk assessment for a policyholder, appropriate documentation in the submission and placement of an general liability insurance policy, underwriting of an insurance risk, the unfortunate result of a coverage disclaimer, and the way the insurance broker becomes a “stop gap” for a policyholder in the event there is no coverage. It shows the situation from a multitude of perspectives—from the policyholder’s vantage, the retail insurance broker, a wholesale intermediary and an insurance company placing the risk. It gives insurance licensees the legal concepts and remedies that are related to analysis of risk and appropriate insurance for a policyholder, identifying and explaining the sources of liability to the insurance broker in the placement of coverage, and the type of missing documentation that can be problematic for the broker. It also shows the attendees the practical realities of the facts and evidence through the lens of a real trial, including the impact of rules of Evidence and Civil Procedure.
